Canada is conducting a two-step bid evaluation process for this requirement. For details on the
two-step process, refer to Annex F - Evaluation Procedures and Basis of Selection.

EVALUATION PROCEDURES AND BASIS OF SELECTION
1.
Evaluation Procedures
Offers will be assessed in accordance with the entire requirement of the solicitation including the
technical, management, financial evaluation criteria. For the purposes of this solicitation, Canada
will utilize a two-step evaluation process as more fully described herein.
An evaluation team composed of representatives of Canada will evaluate the offers.
1.1
Evaluation Overview and Underlying Principles
Canada is conducting a two-step evaluation process for this requirement. Step 1 consists of an
evaluation of an Offeror’s offer and, if necessary, the release of a Preliminary Evaluation Report
to all Offerors. Step 2 consists of an evaluation of the remaining sections and, if issued, Offerors
responses to the Preliminary Evaluation Report. Only those offers deemed to be responsive at
the completion of Step 1 will be evaluated at Step 2.
(a)
Notwithstanding the limited review which Canada may conduct for certain parts of
the solicitation during Step 1, Offerors are and will remain solely responsible for
the accuracy and completeness of their offers and Canada does not undertake, by
reason of this review, any obligations or responsibility for identifying errors or
omissions in offers submitted nor does Canada undertake to identify any or all
such errors or omissions. OFFERORS ARE AND WILL REMAIN SOLELY
RESPONSIBLE FOR ENSURING CONSISTENCY OF THE INFORMATION
SUBMITTED IN THEIR OFERS AT ALL TIMES. WITHOUT LIMITING THE
FOREGOING, OFFERORS ARE AND WILL REMAIN SOLELY RESPONSIBLE FOR
ENSURING THAT ANY INFORMATION PROVIDED IN RESPONSE TO A
PRELIMINARY EVALUATION REPORT IS CONSISTENT WITH ANY OTHER
INFORMATION ORIGINALLY SUBMITTED IN THEIR OFFER IN RESPONSE TO
OTHER REQUIREMENTS. FAILURE TO DO SO MAY PREJUDICE THE EVALUATION
OF PREVIOUSLY SUBMITTED INFORMATION AND/OR RENDER THE OFFER NONRESPONSIVE.
(b)
This two-step evaluation process shall not limit Canada’s rights under SACC 2006 (201604-04) Standard instructions – Goods or Services – Competitive Requirements nor
Canada’s right to request or accept any information during the solicitation period or after
solicitation closing in circumstances where the solicitation expressly provides for this
right.

Offer Evaluation: Step 1
1.2.1
Canada will conduct an initial review of the following described below.
(a) The offers are properly signed;
(b) The Offeror is properly identified (particularly important in the case of joint ventures);
(c) Acceptance of the terms and conditions of the solicitation the standing offer and resulting
contract, such as offer validity period;
Review Parameters:
Canada will conduct a full review and evaluation of all mandatory requirements detailed in 1.2.1
to:
(a)
Determine if an Offeror’s submission in respect of mandatory requirements having a
pass/fail is considered by Canada to be responsive. An offer will be considered by
Canada to be non-responsive if the offer fails to achieve a compliant “Yes” rating on a
mandatory pass/fail requirement.

1.2.2
REQUIREMENT IS MET
Canada will conduct an initial review of each Section as described below.
(i)
Section I: Technical
Offeror responses to the following solicitation requirement documents will be reviewed:
(a)
Appendix #1 of Annex A
A1.0
Documentation
The Offeror must provide documentation (example instrument specification, publication, and
documented data) demonstrating that their proposed products meet all the technical
specifications detailed below. When published documentation does not demonstrate compliance,
a written narrative demonstrating compliance will be accepted. Canada reserves the right to verify
any and all information.
Review Parameters:
Canada will conduct a full review and evaluation of all mandatory requirements in accordance
with the procedures of A1.0 Documentation of Appendix #1 of Annex A to:
(a)
Determine if an Offeror’s submission in respect of mandatory requirements having a
pass/fail is considered by Canada to be responsive. An offer will be considered by
Canada to be non-responsive if the offer fails to achieve a compliant “Yes” rating on a
mandatory pass/fail requirement.

Mandatory Specification
M1
A side loading compact low velocity single shot 40 x 46 mm
caliber module consisting of a receiver and barrel assembly is
being sought. A side loading or side-tilting barrel design is
required to allow ease of loading while in a firing position (without
the need to change the sight line to the intended target).
Must be chambered for Low Velocity (LV) 40 x 46 mm munitions
with the capability of firing most commonly manufactured 40 mm
less lethal and chemical munitions used in military and law
enforcement applications.
Must be a launcher module (herein referred to as module) in
current use within military or law enforcement circles, having
completed 5 years of military or law enforcement trials.
Module must function with 100% reliably within a temperature
range of -40° C to 71° C.
Module must feature an integral pistol grip having an external
ambidextrous safety lever easily accessed from either side while
grasping said grip.
Module must have a minimum of three safety features of which
one must be a manual safety, a trigger safety (trigger will not
function unless barrel is locked in place), hammer/firing pin safety
(prevent operation of the hammer/firing pin in the event launcher
is dropped).
Module must feature a double action mode of fire having a
smooth and predictable release; mechanism must be so
designed to be self-resetting to allow for double strike capability
with no need to re-cock or re-activate the firing mechanism;
maximum trigger pull weight should not exceed 60 Newton’s.
Module must feature a spring actuated, side loading or side-tilting
barrel assembly having a barrel length tolerance of 285 mm to
300 mm measured from the breech face to the end of the barrel
(includes chamber area).
The barrel release must be ambidextrous, be located within easy
reach of the trigger finger or firing hand, not require two hands to
manipulate i.e. can be manipulated using a strong hand grip only
(a suitable location would be within the confines of the trigger
guard).
The external muzzle end of the barrel must feature a threaded
portion to allow accessories such as a launching cup to be affixed
via a threaded interface arrangement.
Module external dimension with no optic or stock assembly must
not exceed 350 mm Length x 99 mm Width x 168 mm Height.
Launcher bare weight (no mount or other accessory items) must
not exceed 1370g.
The module must be manufactured of high strength aluminum
with a hard coat anodized matte black finish.
Module housing must be so designed to allow various options
with respect to mounting accessories i.e. sights, weapon
mounting options, stand-alone stock configurations etc.

Module breech face must use a firing pin bushing which may be
replaced in the event that the firing pin through hole becomes
worn or damaged.
Module must feature an integral MIL-STD (Picatinny) rail forward
of the trigger guard to allow accessories such as a vertical grip to
be affixed.
The module must be supplied by an authorized retailer within
Canada who must be able to manage any Warranty/Repair
services direct to the Original Equipment Manufacturer.
(ii)
Section II: Financial
Offeror responses to the following solicitation requirement documents will be reviewed:
Annex B – Basis of Payment
Review Parameters:
A full review of the Financial Offer is not conducted at Step 1. Canada’s initial review will be
limited to identifying whether required data is missing from the offer or whether GST/HST
amounts are not shown separately. In instances where a different price for the same item is
provided in more than one location within the Financial Offer, Canada will identify this
discrepancy and the Offeror must confirm which price applies.
Where a required line item has been left blank, only the missing information may be added to the
Financial Offer for Step 2, except that, in those instances where the addition of such information
will necessarily result in a change to other pricing or cost information previously submitted as a
result of calculations required by the solicitation (for example, the calculation to determine a total
price), such necessary adjustments shall be identified by the Offeror and only these adjustments
shall be made. Any other changes to the offer shall be considered to be new information
and will be disregarded.
Canada will also identify any instances where an Offeror has failed to submit a required
certification or proof of compliance or where a submitted document lacks the requisite
signature(s) only for the above-noted documents and those documents which must otherwise be
submitted with the Financial Offer.
1.2.3
After this initial review, if any offer is determined to be non-responsive in accordance with the
review parameters noted above, the Contracting Authority will provide each Offeror with a
“Preliminary Evaluation Report” (or “Report”) listing only the instances where the offer is nonresponsive to the requirements of the solicitation (and, for mandatory point-rated requirements,
the score for such requirement) and the applicable solicitation references.
1.2.4
Offerors whose offers are considered to be non-responsive will be invited by the Contracting
Authority to submit additional or different information to demonstrate to Canada within two
business days, in accordance with the solicitation, that the offer is compliant with the solicitation
requirements. Except as expressly permitted above, information submitted for any other
line item or category will not be considered nor will submitted information be used to
evaluate any other section of an Offeror’s offer or the solicitation requirement.
1.2.5
For Offerors whose offers are considered to be responsive, the Report will only identify that they
are responsive for the mandatory requirements evaluated.
1.2.6
All Offerors are requested to provide written confirmation of receipt of the Report to the
Contracting Authority. Offerors who do not confirm receipt will be deemed to have received the
Report as of the date issued by Canada.

Only non-responsive Offerors shall submit further information in response to the Report.
1.2.8
Information submitted by non-responsive Offerors in response to the Report and accepted by
Canada will be deemed to replace, in full, only the non-responsive information or response in the
Offeror’s original offer as identified in the Report and will be used for the remainder of the
evaluation process.
1.2.9
The Offeror’s response to the Report must follow the Offer Preparation Instructions (such
as, for example, separating financial information from other information as required).
Canada requests that Offerors clearly indicate, for each response, which non-responsive
requirement identified in the Report is being responded to.
1.2.10 Responses to the Report must be submitted to the Contracting Authority on or before the date
and time specified in the Report. Failure to do so will result in the offer being deemed nonresponsive and the offer will receive no further consideration.
1.2.11 Any adjustments to a non-responsive offer are at the Offeror’s sole discretion and will be made
solely by the Offeror. Canada will not provide information about any other offer or any information
as to how an Offeror should complete its response, if any, to the Report. Offerors are and will
remain solely responsible for the accuracy and completeness of their offers and Canada
does not undertake, by reason of this review, any obligations or responsibility for
identifying errors or omissions in offers submitted nor does Canada undertake to identify
any or all such errors or omissions. OFFERORS ARE AND WILL REMAIN SOLELY
RESPONSIBLE FOR ENSURING CONSISTENCY OF THE INFORMATION SUBMITTED IN
THEIR OFFERS AT ALL TIMES. WITHOUT LIMITING THE FOREGOING, OFFERORS ARE
AND WILL REMAIN SOLELY RESPONSIBLE FOR ENSURING THAT ANY INFORMATION
PROVIDED IN RESPONSE TO A PRELIMINARY EVALUATION REPORT IS CONSISTENT
WITH ANY OTHER INFORMATION ORIGINALLY SUBMITTED IN THEIR OFFER IN
RESPONSE TO OTHER REQUIREMENTS. FAILURE TO DO SO MAY PREJUDICE THE
EVALUATION OF PREVIOUSLY SUBMITTED INFORMATION AND/OR RENDER THE OFFER
NON-RESPONSIVE.
1.2.12 For those instances where a Offeror chooses not to submit additional or different information for a
requirement identified as non-responsive in the Report, the Offeror must submit a response
indicating “No Change” for such requirement and the original response for that item will continue
to apply. If an Offeror does not respond to a requirement identified as non-responsive, the
Offeror will be deemed to have provided a “No Change” response and the original response for
that item will continue to apply.
1.3
Preliminary Evaluation Report: Step 1
Once a Preliminary Evaluation Report is issued:
Canada will conduct a final review of the non-responsive requirements listed in the “Preliminary
Evaluation Report” provided to each Offeror, taking into account the additional or different
information submitted, to determine if these requirements have been met as required in the
solicitation. Should one or more of the requirements initially evaluated as non-responsive
continue to be evaluated as non-responsive after review of the additional or different information,
the offer will be deemed non-responsive and will not be given any further consideration. The offer
will also be evaluated as non-responsive if the additional or different information submitted
renders non-responsive any other mandatory requirements, including point rated criteria having a
minimum pass standard.

Offers that have demonstrated responsiveness at the conclusion of the final review of all
mandatory requirements, including minimum assessment values or point rated criteria having a
minimum pass standard, will continue to be evaluated at Step 2.
1.4
Financial Offer Evaluation: Step 2
Canada will conduct a full review and evaluation of the Financial Offers for those Offerors whose
offers have demonstrated responsiveness at the conclusion of the final review of all mandatory
requirements.
2.
Conclusion of Step 1 and Step 2
To be declared responsive at the conclusion of Step 1 and Step 2 an offer must:
(a)
Comply with all the requirements of the solicitation;
(b)
Meet all mandatory criteria;
Offers not meeting all of the foregoing requirements will be declared non-responsive, and receive
no further consideration.
